MESA - A former Higley High School choir teacher who fathered a child with a 15-year-old student was sentenced Friday to three months in prison.
Ben LeMere, 27, had signed a plea deal admitting to sexual conduct with a minor in exchange for no prison time.
But Judge Linda Akers rejected that part of the agreement and sentenced him to three months in prison.
Prosecutors told the court that they erred when they agreed to seek no prison time in the case.
