AG files suit against bar owners for violating new smoking ban

PHOENIX - Arizona Attorney General Terry Goddard has filed a lawsuit against four Phoenix businesses, accusing them of violating the state's new smoking ban.
In a complaint filed Monday, Goddard asked Maricopa County Superior Court to issue an injunction against the businesses until they come into compliance.
Goddard also wants the businesses and their owners to be fined for the violations. The requested fines range from $6,400 to $41,600.
The voter-approved smoking ban went into effect May 1 and requires bars, restaurants and other indoor public places to prohibit smoking.
Goddard said the businesses he is going after have tried to get around the law by installing vents in walls, replacing windows with vents, and propping open doors. The businesses argue that by doing so, their establishments are no longer enclosed.
"They have been openly ignoring the law, and all of our efforts to get them to play by the rules have fallen flat," Department of Health Services Director Susan Gerard said in a news release.
The businesses are Metro Sportz Bar and Restaurant, Boomerang Bar and Billiards, River City Pockets and the Maverick Saloon. Alfonso Larriva, who owns or helps operate all four businesses, did not immediately return a call for comment Monday.
Earlier this month, Larriva said he doesn't believe he is violating the smoking ban.
"We are going to take this all the way through the system," he said. "Other people are just scared to do it because the fines can be large. But we're not breaking the law, so we're not worried."
Goddard is seeking a $41,600 fine against Larriva.
