Rapper DMX to be sentenced for felony charges

Earl Simmons, the rapper best known as DMX, is facing a minimum of 90 days in jail for four offenses including felony drug-related charges, but could be locked up for more than 10 years if he violates the terms of his probation once he is sentenced, the Maricopa County Attorney’s Office released Tuesday.

Simmons, 38, of Phoenix, pleaded guilty in Maricopa County Superior Court on Tuesday to one count each of animal cruelty, drug and marijuana possession and theft, the county attorney’s office announced.

In exchange for the guilty pleas, a series of lesser charges will be dismissed at the time of his sentencing, and Simmons will remain in custody until his sentencing on Jan. 30.

He appeared in court on Wednesday wearing handcuffs and a black and white striped prison outfit, along with a pink T-shirt and jail-issued sandals.

The animal cruelty charge, a misdemeanor, stems from when the Maricopa County Sheriff’s Office conducted a search at Simmons' home in August 2007. Investigating a report of animal abuse, authorities found three dead dogs, guns, ammunition and drug paraphernalia.

As part of his probation, Simmons cannot own any animals or possess any firearms after his sentencing, according to the county attorney’s office.
