A man is in critical condition after his sister was suspected of shooting him in the head early Friday morning in central Scottsdale.

Sam Stewart, 50, showed up at his brother Jack's house in the 11000 block of North 74th Street unexpectedly and the two got into a fight at about 12:20 a.m. Friday, said Sgt. Mark Clark.

Sam Stewart, Jack Stewart, 48, and Marion Stewart, 49, his sister, have had an ongoing legal battle over their deceased mother's Phoenix home, he said.

After Sam Stewart physically attacked his brother, Marion Stewart felt her younger brother's life was in danger, Clark said. She grabbed a handgun from inside the home and shot her older brother, he said.

Sam Stewart was taken to Scottsdale Healthcare Osborn and underwent surgery, Clark said.

No arrests have been made, and Jack and Marion Stewart are cooperating with police while they investigate the shooting, Clark said.
