A House panel voted Tuesday to trim the right of illegal immigrants or their survivors to collect damages from those who hurt or kill them.

SB1057 would limit the right to sue to only actual damages. That includes things such as medical bills and lost wages.

Off limits would be any extra financial penalty imposed by a judge or jury against wrongdoers specifically as punishment. And there could be no collection for pain and suffering.

That also means the relatives of a border crosser or illegal immigrant killed by someone else’s negligence or intent would be eligible to sue solely for burial costs.

Rep. Russell Pearce, RMesa, said the measure still protects the right of illegal entrants “to be made whole” for injuries.

The House Appropriations Committee is not taking any chance on a potential veto by Gov. Janet Napolitano: It voted to put an identical proposal on the November ballot. Ballot items are not subject to gubernatorial review.
