A 41-year-old man died Saturday from injuries he received in a beating June 28, opening the door for homicide charges for the man accused of inflicting them.
According to Sgt. Mark Marino, Gilbert police spokesman, Daniel Durgin, 38, knocked out John Jay Cruz during a fight at 1 a.m. in the street in the 1600 block of Robin Lane. Durgin continued to pummel Cruz as he lay on the ground unconscious, police said.
Marino said Cruz was drunk and disorderly at a party and his 32-year-old sister asked him to leave.
Cruz began fighting with his sister when the other partygoers, including Durgin, came outside.
Cruz's sister tried to intervene as Durgin continued to punch her unconscious brother, but he knocked her out as well, according to Marino.
Police arrested Durgin a few minutes later at Lindsay and Warner roads.
