A judge rejected prosecutors’ efforts Tuesday to jail a former school nurse until she stands trial on charges she molested a 13-year-old boy.
A prosecutor accused Scottsdale resident Courtney Bisbee, who is free on $100,000 bail, of violating conditions of her release by developing a relationship with the boy’s father in order to influence the victim and witnesses in the case.
Judge Warren Granville ruled in Maricopa County Superior Court that Bisbee didn’t violate any conditions of her release, but that her actions could lead to future criminal charges, which he didn’t elaborate on.
Bisbee is not allowed to "initiate contact of any nature with the alleged victims" while she is free and her case is pending trial, court documents state.
According to court documents and police reports, the former Horizon High School nurse attended a family court hearing regarding child custody issues between the boy’s divorced parents in August.
Defense attorney John Gaertner said Bisbee had permission from the court’s agency that supervises people who are free on bail to attend the family court hearing.
Bisbee and the father, whose name the Tribune is withholding to protect the boy, now 14, both told police Bisbee had an interest in the outcome of the hearing.
"So that I could talk to (the victim) about, about what happened, you know why is, why is he doing this," the father is quoted in a transcript of a conversation with a Scottsdale detective.
The father believes the boy is lying.
"To this day, I still don’t believe it’s true," the father said Tuesday.
Bisbee is accused of fondling the boy and having him fondle her during a short relationship in February.
According to a police report, she said they only kissed.
She has pleaded innocent, and her trial is scheduled to begin Dec. 13.
The father said he contacted Bisbee and they had dinner once with Bisbee’s mother to talk about the case. He said their relationship consists mostly of telephone calls.
Granville said Bisbee is prohibited from contacting the father, but he can contact her.
