The Arizona Court of Appeals will hear oral arguments Wednesday in a case that has the Goldwater Institute challenging Mesa's impact fees for cultural amenities.
A Maricopa County Superior Court judge ruled in favor of Mesa in July, saying the city could charge fees to expand museums, preserve archaeological finds and fund other cultural offerings. The fee is $218 for each new single-family home.
The Goldwater Institute argues impact fees can only be used on basic facilities that are burdened by new development, like roads or water and sewer lines. It sued Mesa in 2007 on behalf of the Homebuilders Association of Central Arizona.
A three-judge panel will hear arguments Wednesday.
