Arizona legislation gives businesses more protections during liability lawsuits

Manufacturers would get protection from punitive damages in product liability lawsuits under the terms of legislation approved Tuesday by the Senate.

SB 1336 says these special penalties, imposed to punish a company for unusual wrongdoing or to make an example so others behave, could not be awarded if the product complied with state or federal regulations. The legislation also provides similar protections when the item was designed, manufactured, packaged, labeled or sold in accordance with approval or license of a government agency.

Opponents of the bill, which now goes to the House, said the measure still has loopholes allowing bad behavior to escape the special penalties.
